Will The Center Hold, Part 1: Americans and States Fight Back Against An Overreaching Federal Government

I am 60 years old. I have seen the debacle and divisions in the country caused by the Vietnam war and the resultant anti-war violence and activities during the Johnson and Nixon administrations. I lived through the lifeless and ineffective Carter administration. Since Reagan, I have seen numerous and useless U.S. military invasions and economic hardships that have tried the country’s patience.

However, throughout the needless wars, the protests, the economic downturns, the lackluster, corrupt, and criminal leadership in Washington, I do not recall us ever being so close to a severe Constitutional crisis. This crisis threatens to substantially divide the country along the lines of state rights and individual freedom vs. overreaching Federal government power, an overreach that often and lately has crossed over the line of Constitutionality.

A number of factors are contributing to this fissure between the people and their state governments on one side versus the political class in Washington on the other side:

1. Washington has tried to dictate to the states how a national health care program is to be run even though about two thirds of the states have opted out of the national program by not establishing their own state health care exchanges as stipulated by Osama Care’s tenets.
2. Washington, via Obama Care, has violated the First Amendment’s freedom of religion protection.
3. Washington has spied on every American and continues to do so, causing some states to rise up against this violation of the Fourth Amendment.
4. Washington has tried to squash Second Amendment rights with a blitz of actual and proposed gun control laws and edicts that do not sit well with many states and with a vast number of citizens.
5. Washington is trying to force every state, every school, and every citizen to adhere to a national Federal government mandated education curriculum called Common Core even though it has proven to be deficient in actually improving the education attainment in this country and has little flexibility regarding different needs of different students and states.

Washington is trying to force its control into states' areas of responsibility, as laid out in the Constitution, and into the states’ citizens’ lives. This is resulting in the following unique, severe, and aggressive actions being taken up by those states to protect their Constitutional rights and the rights and privacy of their citizens, a push back I have never seen in my lifetime:

1) The Education Action Group reported on January 29, 2014 that a Colorado state senator, Vick Marble, has introduced legislation that would push back the implementation of Washington’s Common Core education programs for one year. The purpose of the delay is create time so that a state task force would be able to study implementation of the Colorado academic standards, including the Common Core. The state task force would report its findings and make recommendations to state lawmakers and the Colorado State Board of Education by December, 2015.

Marble’s bill would also identify an outside group “to conduct a cost-benefit analysis of implementing the new standards and new tests.” What was Marble‘s reasoning behind creating the delay: “The bill is intended to give Colorado the time it needs to explore Common Core in all aspects instead of handing over our children to an experimental education program with no proven track record of success.”

Additionally, a member of the house of representatives in the state government is introducing similar legislation. Whether either effort gets anywhere remains to be seen but at least some people and citizens in Colorado are saying “slow down” before they blindly accept a program forced upon them by the Federal government.

2) In late January, Oklahoma state government Representative Mike Ritze introduced state legislation that would be similar to that of South Carolina's Obama Care’s “nullify” legislation. Both states’ legislation would essentially gut the Affordable Care Act in their state.

Ritze’s bill, HB2421, states that:

• "An agency, officer, or employee of the state [Oklahoma] shall not…engage in an activity that aids any person in the enforcement of the Patient Protection and Affordable Care Act. [I.e. Obama Care]" 
• The legislation bars Oklahoma from setting up a state-run Obama Care health insurance exchange to support Obama Care.
• It prohibits the purchase of insurance from an exchange set up by a non-profit. 
• It also blocks any state agency or personnel from conducting involuntary home inspections as provided for in the Obama Care legislation.

This attempt to “nullify” this Federal law is being done under the auspices of the Tenth Amendment of the Constitution:

The Powers not delegated to the United States by the Constitution, and not prohibited by it to the states, are reserved to the states respectively, or to the people.

The purpose of this amendment was to do prevent exactly what the Federal government and the Obama administration are doing now in so many ways, intruding into the rights and lives of states and citizens. This is Oklahoma’s way of pushing back along Constitutional lines and openly defying a national law passed in Washington.

What is interesting is that Oklahoma is not a solitary “renegade” state. News sources identify other states including South Carolina, Indiana, Tennessee, Missouri, and Georgia having also put forth their own efforts to nullify Obama Care.

Which raises an interesting question: what if the Federal government enacted a law and no one, state governments and citizens alike, ignored it? Or nullified it? 

3) News reports out of South Carolina in late January, 2014 reported on another worthy state effort to protect its citizens and Constitutional rights. It is no secret that the Obama administration has shredded the Fourth Amendment rights and privacy rights of every U.S. citizen by blatantly collecting and storing information on every conceivable electronic communication that every American creates.

These collection and storage processes are done without probable cause and without a properly obtained warrant from a proper court of law. It is a gross violation of the Fourth Amendment no matter how viewed. Saying this massive data collection is needed for national security is a farce, the data and information collected is far more likely to be used for political gain and revenge.

Which brings us to another uncharted frontier regarding invasion of our privacy. The U.S. has been a major user of unmanned drone aircraft around the war, using them extensively to bomb suspected terrorist havens around the world. Which has given rise to an new fear and threat to the Fourth Amendment: what if this same government decides to deploy drones to spy on Americans?

Well, in another attempt to nullify Federal interference in our lives, the South Carolina state senate late last month began considering a bill to virtually ban the use of drones without a warrant in its airspace. A similar proposal (HR3514) recently passed the South Carolina state house unanimously, with a vote of 100-0.

Details behind this worthwhile effort includes the following:

• House bill 3514 (H3514) would prohibit the operation of drones by any government agency unless it is “pursuant to a criminal warrant issued by a court of competent jurisdiction.”
• Although all of the sponsors of the legislation were Republicans, the unanimous support shows a strong bipartisan effort to block the Obama administration’s drone program. The The ACLU has weighed in on this domestic drone issue on a national level as well, warning that “unregulated drone use could pose serious threats to our privacy.”
• The South Carolina legislation does include some narrow exceptions to the warrant requirement to reduce the trepidations of state law enforcement entities who want to be able to act in emergency situations when a drone’s use might mean the difference between life or death.
• Even so, the bill still retains strict standards governing the use of a drone when authorized. 
• For one thing, the law would ban any sort of weapon from ever being mounted on a drone in South Carolina.
• Once a drone was used, law enforcement would have to keep records on the results of their surveillance. 
• Other sections of the bill would prevent law enforcement from retaining any drone-obtained personal information not relevant to a criminal investigation. 
• Amanda Bowers of Tenth Amendment Center was quoted in news articles stating that South Carolina could join a growing number of states putting strict limited on drone usage within their state borders: “Already, a number of states have passed similar bills into law, and we are expecting more in the coming weeks and months. From California to Washington State, and from New York to Missouri, legislators and the general public from left to right want to see a dangerous future stopped before it happens.”
• Similar laws apparently were signed into law in 2013 in Florida, Idaho, Illinois, Oregon, Tennessee, Texas and Virginia.

Interesting, dynamic stuff. States and citizens telling the overreaching Federal government to pound sand when it comes to dictating education standards, dictating health care standards and operations, and potentially violating the Fourth Amendment rights of citizens with the new technology of drones. All seemingly legal and above board according to the Tenth Amendment to the Constitution.

One has to wonder if Common Core had been a decent program, if Obama Care actually had a chance to work (it doesn't), and if the Federal government was not already grossly violating the Fourth Amendment and privacy rights of citizens if the state governments and leadership would have done anything as drastic as to invoke its Tenth Amendment rights.

Given that such action has not occurred to my knowledge over the past 60 years, I have to conclude that Common Core, Obama Care, and drone intrusions are really as bad as these states think they are.

Which gets us back to the basic question we proposed above: what if the Federal government enacted a law and everyone, state governments and citizens alike, ignored it? Do the ties that bind us together as one nation, as dictated by the Constitution, become the loosened and if so, to what degree? More on the rebellion tomorrow.

Part 6, August, 2013 Obama Care Update: Main Stream Media Finally Recognizes the Disaster, Major Unfinished Operational Tasks, and More

Okay, apologies up front. Over the past six days we have been examining and reviewing the many disasters and fiascoes that were spawned as a result of Obama Care. One would have thought six days would have been enough.

We reviewed the long list of root causes underlying our high health care costs and how Obama Care addresses almost none of them.

We reviewed how Obama Care is causing American workers to lose salary hours, reducing their take home pay.

We reviewed how Obama Care is causing business owners to pull back on hiring and business expansion, stunting overall economic growth in the country.

We  reviewed how the  underlying systems to support the rollout of some major components of Obama Care are far behind schedule and are likely to not be ready when scheduled.

We reviewed how the inadequate training of Obama Care “navigators” and the inadequate data systems security protocols will turn Obama Care’s processes into an identity thief’s paradise.

We reviewed how seven million Americans, per the Congressional Budget Office,  are likely to lose access to their current health care insurance programs, the exact opposite of what Obama Care was supposed to do.

We reviewed how Americans are likely to experience severe sticker price shock when they see how substantially higher their health care premiums are going to be under Obama Care.

We reviewed how smaller hospitals are likely to see severe economic days as Obama Care raped the Medicaid and Medicare budgets to fund its own processes.

We reviewed how every reputable opinion poll over the past few weeks has shown that the majority or at least plurality of Americans see Obama Care as a bad thing, respondents think that they will end paying more for health insurance, and are scared about losing their current health insurance options.

We reviewed how Obama and other politicians are illegally changing aspects of the legislation without going back through the proper legislative Congressional approval of those changes.

And after all of this review, we still have not covered all of the problems, given the new problems that have arisen just in the past week or so. Rather than wait until next month when we do another set of reviews, we thought it was important to get the following insanity out there for your review and depression:

1) The family of NBC news outlets have always been the most biased in their reporting when it comes to Barack Obama. They often come off as just another arm of the President’s public relations department. Thus, when someone like NBC News airs a news segment that is critical of Obama Care you know that it must be a bad piece of legislation. Consider the following quotes taken directly from the broadcast of such a piece on August 13, 2013:

• The NBC Nightly News segment concluded that there would be adverse impacts of Obama Care on the people it intends to help, leaving some “with no insurance and a pay cut.”
• Lisa Myers, a reporter involved in the segment, stated that NBC News “spoke to almost 20 small businesses and other entities around the country. Almost all said because of the new law, they’d be cutting back hours for some employees.” 
• Additionally, a top union head told NBC News:”Wait a year, and you’ll see a tremendous impact as workers have their hours reduced and their incomes reduced.”

So, NBC News has found that Americans, small businesses, and unions do not like and fear Obama Care. These are the entities that are most likely to be impacted by the legislation so someone in Washington should be heeding their opinions before this disaster hit’s the proverbial fan.

2) Unfortunately, it appears that many people in the Obama administration are NOT heeding these opinions. In the same NBC News segment, Jason Furman, who is a  top economic adviser to President Obama, said that he “sees no systematic evidence” that the health-care law is “having an adverse impact on the number of hours people are working.

No disrespect to Mr. Fruman, let’s give him the benefit of the doubt and say that this administration made him deny the reality that has been in the news, and reported in this blog, for at least the past two years. We have discussed the many businesses and government entities that have issued press releases or held news conferences announcing how they were cutting workers hours and cutting the number of jobs they could be filling all because of Obama Care.

To not be aware of these realities is very scary. It shows an administration that is either very out of touch with reality, does not want to know about reality, thinks that they can lie about reality, or really does not care what is happening to American workers. In any case, their actions are irresponsible and despicable.

3) Previously, we had discussed the fact that legal cases against Obama Care were moving forward and that many of them, according to experts, had merit and a real chance of succeeding. One of the suits, filed by the Oklahoma attorney general, made it through a major milestone this week when that attorney general, Scott Pruitt announced: “The court rejected the federal government’s argument that Oklahoma lacked standing to challenge the law, allowing us to proceed with this pivotal case. We’re optimistic the court will recognize what states have known for months that the IRS disregarded the law by making the large employer mandate effective in Oklahoma or in any of the 33 other states without a state health care exchange.”

Apparently, the legislation, as written and enacted, does not allow the Federal government to force itself, its tenets, and the IRS onto the 34 states that have rejected setting up their own Obama Care health insurance exchanges. The Supreme Court decision that said Obama care was legal also gave the states the right to opt out of the exchange process. Obama knows that if 34 states are not included in the overall Obama Care effort, the financials and momentum of the legislation collapses, which would be good news for America, bad news for Obama. The first step towards the potentially good outcome is in the books.

4) The American Action Forum website recently published a pictorial representation of what has to be done in the next 50 days to make Obama Care operational. Remember, these people have had three years to get ready for this major October 1, 2013 rollout. 

According to the website, fifty major tasks have to miraculously come together in just 50 days for this monstrosity to have any chance of working. Take a look for yourself of what still has to be done and ask honestly yourself if this is not truly a “train wreck” (Senator Max Baucus’s words) ready to implode (double click picture for a larger view):

Consider some of the words that the mainstream press are using to describe what is happening: train wreck, costing jobs, delays, costs to rise, fret, fears, angry, unaffordable, destroy, skeptical, confused, etc. Even if you do not believe me, check out some of these articles to find others’ pessimistic outlooks on how bad this legislation is going to be. Apparently everyone sees the train wreck coming but those that work in the White House and this administration.

That’s enough for today. But tomorrow is another day where I promise it will be the end of the bad news from Obama Care… for this month.

Part 2, August, 2013 Obama Care Update: Navigators That Cannot Navigate, More Polls Down On Obama Care, And Breaking The Law That Is Obama Care

Yesterday was the first update for this month regarding the ongoing disaster that is Obama Care. In that post we found that insurance premiums are gong up, not down, as promised by Obama. Insurance companies are either pulling out of state based Obama Care exchanges because they cannot make money by being in them or they are proposing premium increase that are gag-worthy. Opinion polls from the Wall Street Journal and other mainstream media news sources all show the substantial opposition to the law’s tenets, requirements, and absurdity.

But all of the bad news could not be contained in just one post, Today we continue with the disasters we did not cover yesterday.

1) The Washington Post recently did an investigative report on the implementation of Obama Care. One aspect of the report is a series of quotes that they found from SUPPORTERS of Obama Care, not the majority of Americans who think Obama Care is not a good thing. As you read these supporters’ quote, remember that we are less than 60 days from a rollout of a major component of the law:

• “Advocates on the ground are really struggling with that group. They want to have a positive message but don’t know what to say.”
• “We’re in an environment [now] where 40 percent are against it, 35 percent are for it and neither side knows what’s actually in it.”
• “How hard does the insurance department or Medicaid department in a red state [that opposes the law] make it to implement this?”
• “Everybody is having sleepless nights given the magnitude of the effort and the short amount of time.”
• “It’s like building a bridge from both ends and hoping, in the end, they connect.”
• “I read [the delay of the employer-mandate] as an admission that not all of the components of the [data] hub are working.”
• “Some of the guidance from the federal government is still coming. That means we can’t get to our wish list.”

I especially like the quote of building a bridge from two different shores and hoping that they actually connect in the middle of the river (this quote could probably apply to all Federal government programs). These are what supporters say about this unfolding fiasco.

2) Two other noteworthy facts were included in the Post’s negative report on Obama Care:

1. A recent  Huffington Post opinion survey found that 52.5% of Americans are against ObamaCare, compared to 40.5% who are for it. This 12-point gap is the largest gap that this poll has ever measured.
2. Another recent survey, according to the article, asked younger Americans whether a $210 premium under Obama Care was affordable. Only 29% of likely marketplace enrollees said yes.

This second point is critical. The Post concluded in its report that if a large number of young Americans do not sign up for Obama Care, which today is a highly likely occurrence according to poll results, the “law will fail.” 

3) Cato had a recent analysis of the potential risk Obama Care faces from a set of lawsuits that have been filed across the country. These lawsuits are particularly important in light of the critical need for the Obama administration to have a lot of young people sign up for Obama Care health care insurance:

• The attorney general of Oklahoma, a group of small businesses, and individual Americans across the country have filed lawsuits which challenge the Obama administration’s plans to issue Obama Care tax credits in the 34 states that have opted not to establish one of Obama Care’s health insurance exchanges themselves. 
• The law’s writing explicitly only  authorizes those credits and related subsidies “through an Exchange established by the State.” 
• Nowhere, and in no manner, does Obama Care allow the administration and Federal government to issue credits through the 34 state Federal-based exchanges established and operated by the Federal government. 
• Despite the wording of the legislation, the White House is trying to spend an estimated $700 billion over 10 years in those 34 states without state health care exchanges and without Congressional authorization.
• Both the non-partisan Congressional Research Service and Harvard Law Review have found that these lawsuits are credible. 
• Plaintiffs in one of the suits have asked the court to block that illegal spending before it begins in 2014. 
• Supporters of the law admit that if that happens, according to the Cato report,  Obama Care does not just fail, it collapses.

It is hard to believe that this monstrosity of a law still works if about 68% of the young Americans in 34 states do not get any support at all to pay for overpriced Federal health insurance exchanges. 

4) We have reported on how many entities, both private and governmental, have had to cut workers and/or cut workers’ hours since Obama Care will impose impossible costs on their operations, costs that require them to find other ways to stay solvent. A recent article from July 23, 2013 in Florida Today reported on how a Florida county has had to cut staff hours strictly as a result of Obama Care:

• Obama Care’s Mandates Would Cost Brevard County $10,000 A Year Per Employee: Brevard County Insurance Director Jerry Visco said every employee added to the county’s health insurance program could cost the county about $10,000 a year per person, and ‘that money is not there’ in the county budget.
• Annual Estimated Total Cost To Brevard County — $1.38 Million A Year: According to Director Visco’s analysis, providing health insurance to 138 part-time workers under Obama Care would cost the county $1.38 million a year.
• To Date, 37 Brevard County Library Employees Have Had Their Hours Cut: Brevard County Library Service Department Director Jeff Thompson said 37 of his department’s employees have had their hours cut as a result of the health care issue. 

More Americans losing salary dollars as a result of a Federal government law that has no chance of being successful. Pitiful.

5) Even though the President has delayed the rollout of some facets of Obama Care for businesses until January, 2015, probably illegally, a recent U.S. Chamber Of Commerce shows how devastating Obama Care will be to small business growth and financial health:

• 24% of small businesses polled say they will reduce hiring as a result of Obama Care‘s tenets, requirements, and taxes.
• 23% of small businesses  plan to replace full time employees with part-time workers to avoid triggering Obama Care’s insurance  mandate.
• Only 30% are ready for the law or even understand what is required.
• Dealing with Obama Care is the biggest worry of small businesses.
• The Chamber survey found that "nearly one-in-four employers say the health care bill is their biggest obstacle to hiring more employees."

Different survey of a different set of Americans but the same results: Obama Care is bad news, more costs for little or no problem resolution.

6) Last set of bad news from Obama Care today. The following distressing and scary facts come from a National Review article from July 22, 2013. Much of the following disasters-waiting-to happen come from testimony given to Congress’ House Oversight and Government Reform Committee in the spring of 2013. Hold on for what will scare the daylights out of you:

• Obama Care "navigators" are supposed to be highly trained specialists that will help Americans understand and obtain the best health care insurance for themselves under Obama Care insurance exchanges. They will theoretically have access to every American’s personal information including name, address, medical history, social security numbers, etc., an identity thief’s data paradise.
• Given that 34 states will not be setting up exchanges, the Federal government will now have to find resources to become navigators and are turning to a wide variety of organizations that have no experience in health care and health care insurance including Planned Parenthood, churches, senior citizens groups, and other organizations that are ill prepared to get things right.
• The Government Accountability Office recently reported that the administration is considering allowing navigators to assist with outreach and enrollment tasks even before completing their formal training. The reason? The navigators program is behind schedule and drowning in its own complexity. So, given that they are untrained, let’s go forward anyway? Insanity.
• Despite the reality that navigators will have access to sensitive personal data such as Social Security numbers and tax returns, there will be no criminal background checks required for them. Indeed, they won’t even have to have high-school diplomas. Can you say massive identity theft? Hiring potential criminals to have such access to such data is beyond stupid.
• Navigators will take a 20–30 hour online course (i.e. no idea of how well they learned in the absence of a trained trainer) about how the 2,000-page law works. This works out to only about four days of training to learn everything they need to know about Obama Care and all of the related insurance plans they will be offering. Not going to happen.
• Even worse, many of the exchanges are also going to serve as voter registration outlets. Talk about incompatibility of objectives, you are either a health insurance expert or a voting registration expert. Trying to do both tasks with severely limited training is a disaster for both objectives.

Tell me this is not a disaster waiting to happen. We have already reported on how calling the IRS “navigators” on their 800# support line almost always gets you different answers for semi-complex tax issues, how can anyone expect a brand new Federal bureaucracy to get it right when the IRS has not gotten it right after decades of trying?

A similar comparison is made at the end of the article relative to the Federal government trying to get any complex task successfully implemented:

If there is a silver lining in all of this, it is that the potential failure of the navigators program could further convince voters that Obama Care is simply unworkable. “The Obama administration wants something the federal government has never done: a computer system that connects HHS, the Internal Revenue Service, the Social Security Administration, Homeland Security and perhaps other departments,” John Goodman, a health-care expert with the National Center for Policy Analysis, wrote in the Wall Street Journal in May. “For perspective, consider that the Veterans Administration converted to electronic medical records in 1998 and the VA and the Defense Department tried without success to share records until February [2013] when then-Secretary of Defense Leon Panetta announced that the plan would be abandoned.”

Fifteen years and probably billions of dollars wasted to get to highly interrelated Federal entities to have their computers talk to each other, an effort that ended in failure. There is no chance that the exchanges and their navigators cannot also end in failure.
