How The American Journalism Profession Is Destroying The First Amendment and Our Democracy

One of the once great things about this country was the First Amendment and the freedom of press guaranteed by it. A free press helps offset the political ambitions and freedom encroachments of politicians by keeping their actions in the sunlight of visibility, disclosure, and scrutiny, i.e. it helps keeps politicians honest.

Unfortunately, we for the most part do not have an unbiased, free press anymore in this country but not in the way you think. Most people, when they think that the free press has been suppressed, consider many of the actions of Presidents like Obama, who was one of the worst Presidents when it came to undermining the free press guarantee of the First Amendment:
  • He went after and prosecuted more whistle blowers than every other President combined.
  • He spied on journalists who he thought was an enemy of his views and efforts without proper cause or warrants.
  • His administration fought tooth and nail, more than any other President, to block legitimate and legal Freedom of Information Act (FOIA) requests.
  • His administration even tried to illegally charge a legitimate news gathering organization, the Associated Press, an outrageous sum of money for a FOIA request.
All of these acts undermined freedom of the press in the traditional way. But unfortunately, freedom of the press has been undermined over recent years not by politicians but by the press industry and journalists themselves. For the most part, and especially at the national level, news organizations have gone from reporting the facts, realities, and news in an unbiased way to shaping those facts, realities, and news in a very biased way. 

When journalists lose their integrity and ethics, the bedrock of their industry and profession, they undermine the First Amendment as much as some shady politician who is trying to get by with shady and unethical behavior. How far have journalists fallen down the integrity scale in Americans’ minds? In a recent Gallup poll:
  • Only 20% of those polled said they had a great deal or quite a lot of confidence in television news.
  • 45% said they had very little or no confidence in television news.
  • Newspapers do not do much better with 23% saying they had a great deal or quite a lot of confidence in newspapers while 40% saying they very little or no confidence in newspapers.
  • Ironically they both did better than Congress whose ratings were most abysmal among all major American institutions.
Consider the following election related stories on how journalists have “earned” these sorry reputations for trust and integrity:
  • Erick Erickson, writing for the Maven website documented the following instances during the election season where journalists got the story mostly wrong, either intentionally or unintentionally, in his article, “Where Do We Go When Journalism Fails Us?”
  • His first example involves the state of Georgia where former Georgia Secretary of State and Republican, Brian Kemp, probably won the race for Governor in that state.
  • National reporters and journalists reported that Kemp tried to close predominantly African American voting locations which forced black voters to travel far distances by driving or walking to voting locations in mostly white neighborhoods which in turn discouraged black voters.
  • Nice story but wrong since it was not Republican Kemp closing these voting locations but it was the Democratic county commissioners and the Democrat controlled local board of elections that closed those locations.
  • They/local Democrats had hired a consultant who recommended closing some voting locations to be in line with the Americans With Disabilities Act requirements.
  • In addition, the locations that were closed were ALL in mostly Republican precincts, not Democratic and black precincts.
  • As you can see, the national press got just about every detail of this story wrong.
  • The Associated Press told the story of a woman in Georgia who was supposedly denied the right to register to vote because, as required by state law, the name she put down on her voter registration form did not exactly match the information on her driver’s license, it was missing a hyphen, and thus, her voter registration application was denied.
  • The AP then went with this story nationwide.
  • But the truth is that she was not allowed to register because she was ALREADY registered to vote. 
  • Despite the screw up, the Associated Press never retracted or amended this incorrect article.
  • The Associated Press also reported that 53,000 Georgia voters had their voter registration paperwork held up and classified as “pending voter” and that the majority of those tied up were from minority voters.
  • This made it look like there was a massive minority voter suppression effort underway.
  • In reality, 75% of those on the pending list had submitted registrations with bogus Social Security numbers.
  • And 23% had been on the voter registration list from 2014 and had had their names re-submitted by the the voter registration efforts of the black Democratic candidate running for governor.
  • Thus, at least 98% of those 53,000 on the pending list did not have their voting rights suppressed, they either were duplicates or had submitted bad information themselves. realities that the Associated Press never mentioned.
  • The national press also ran stories that accused Republican Kemp, as Georgia’s Secretary of State, of kicking minority voters off of voting registration lists to improve his chances of becoming governor.
  • But the reality is that he was prohibited under state law from doing an such thing, the voting registration lists are maintained by local voting officials, they are the only ones allowed to remove people from voting lists because of death, felony conviction, or deemed incompetent.
The article correctly points out why the national media in these cases were more interested in building ratings and readership than reporting the truth and they themselves abused the freedom of the press trust that they should have protected with integrity and ethics: “Local media in Georgia got these stories right while national outlets flubbed them. They distorted the facts and got basic facts wrong. The national reporters wanted to build narrative arches with protagonists and villains instead of just giving people the facts. As local news outlets rely more and more on national reporters or fade away, more stories like these will be reported and even more people will distrust the press.”

2) But it is not just bad, biased reporting of election stories that made the press look bad, their polling results also bring into doubt their integrity. Remember back in the 2016 Presidential election how almost every media poll showed Hillary winning the election? 

One reason they may have all been so wrong is that maybe, like CNN did, they purposely over weighted their polling sample with Democrats/liberals which skewed the results to Clinton. The one conclusion that many people drew, given the bad confidence levels of the press in Americans’ minds, is that CNN wanted to shape the election and make it look like a Clinton victory was a done deal. That in turn would depress and suppress Trump voters and possibly add a bandwagon effect for Clinton, i.e. if CNN says she will win I might as well vote for a winner.

Could this same intentional skewing of poll results, in an effort to affect elections, also happened in the recent midterm elections, as pointed out by an article by Dick Morris:
  • In 40% of the pre-election polls in the most closely watched Senate and governor races, the polls picked the wrong winner.
  • In other words, you could have done almost as good a job on average by flipping a coin in picking winners, 50%, than the major news and polling organizations did with their much more sophisticated efforts.
  • And even when the polls picked the right winner, in 60% of the time they were more than three points wrong in the number of votes the winner got despite their polling methods.
  • The results would be less suspicious if the wrong predictions were more or less equal between Democrats and Republicans. 
  • But these results were also skewed in that 75% of the major polls indicated that Democrats were doing better than what really happened while only 25% doing better than finally happened, a more than random difference.
  • According to Morris: “Of the nine major polling firms, eight showed Democrats doing better than they actually did and only one — Trafalgar — showed Republicans doing better than it turned out.”
  • The NBC/Marist poll was the worst polling effort, overestimating Democratic vote totals by 6.8%.
Given that the press constantly favors Democrats and liberals in their biased reporting and given that the press and their polling partners constantly overestimate the chances of Democrats and liberals in elections prior to voting, it should not be a surprise that Americans who cherish the First Amendment and the freedom of the press guarantee that it provides have a very low and dubious view of the integrity and confidence that the journalism profession has today. The journalists in this country have been entrusted with a very important component of our democracy and sadly, they flub that responsibility every day of their working lives.

November, 2013 The Unfolding Disaster That Is Obama Care, Part 5: Making Divorce More Economical, Twisting Twitter's Arm?,

This is the fifth in our series this month that covers the unfolding disaster that is Obama Care. Over the years, and especially the past few months, it has been increasingly more difficult to keep up with the idiocy, insanity, and wastefulness of this legislation. In just the past three months we have had to dedicate almost thirty daily posts just to get through all of the nonsense. I do not know how many posts it will take this month to get through it all since more insanity pops as quickly as we review it.

As we promised earlier this week, we are not going into to tremendous details, analyses, and background on the latest bad news. We have done that in-depth work in the past few months. This week and probably next, we are just trying to document and stay ahead of the bad news from the worst piece of legislation ever written.

1) We have often pointed out how the writers of Obama Care never stopped to examine their logic train to make sure that stupid stuff did not happen as a result of the law. But, unfortunately, stupid stuff keeps popping up as a result of the law. 

Consider a November 6, 2013 report from CBS News in New York. Nona Willis Aronowitz and Aaron Cassara’s love affair began at a party in 2008 and within a year they found themselves getting married at the NYC  City Hall in Manhattan. However, four years later they realized they could save thousands of dollars annually if they got divorced and signed up for health insurance via Obama Care. 

The math calculation  for Aronowitz and Cassara is that together as a family of only two, they make more than the $62,000 level to qualify for Obama Care. However, if they got divorced and lived together unmarried, they would qualify for the law’s subsidies and could literally save hundreds of dollars a month on their health care.

Why? A single person can qualify for Obama Care subsidies if their income is less than $46,000 a year. Thus, by living together, unmarried, the stupidity of the Obama Care math makes it very profitable to get divorced for these two New Yorkers and probably many other Americans across the country. 

You cannot say any law is a good piece of legislation when it reaches so deeply down into a family and forces the family to make the life impacting decision to get a divorce. Pathetic.

2) This Presidential administration promised to be the most transparent ever. We have proven that promise to be a joke any number of times but the latest proof of this false claim recently came about relative to Obama Care. 

A website that tracks the health care policy cancellations and the skyrocketing  premiums and deductibles being caused by Obama Care, mycancellation.com, has had a rough start, with Twitter freezing its Twitter account at least three times since the site launched last week. Twitter provided no advance notice or warning of the disruption to their service and the people operating the website and related Twitter account suspect there is some political motivation or arm twisting behind the scenes to silence the bad news that their effort is uncovering. Definitely not a transparency friendly atmosphere if that arm twisting is coming from the Obama administration.

But the other half of the story beyond the news suppression, is the incredible number of stories that Americans are sending into this collection effort along with copies of their policy cancellation letters and the notices of how much their current health care costs will be going up if they are fortunate enough not to have their policies cancelled. 3) Any reasonable person would probably conclude that media empire NBC has been a fervent and biased supporter of Obama from day one of his administration. We could go off on why and how they are so biased but it is funny what happened in late October. CNBC’s morning anchors discussed the recent news that their own insurance plans will become more expensive because of  Obama Care.

On Oct. 30’s “Squawk Box,” CNBC correspondent Scott Cohn revealed details of NBC’s open enrollment, showing an official fact book outlining the process. He quoted the document, revealing that Obama Care would increase NBC employee health insurance premiums. Cohn observed “Some of these costs, when you look at this, are way up -- double digits.” Well duh?

4) When CNN reports something bad about the Obama administration, you know that the administration really screwed up. CNN reported in early November: 

Senate Democrats voted unanimously three years ago to support the Obamacare rule that is largely responsible for some of the health insurance cancellation letters that are going out.

In September 2010, Senate Republicans brought a resolution to the floor to block implementation of the grandfather rule, warning that it would result in canceled policies and violate President Barack Obama’s promise that people could keep their insurance if they liked it.

Rather than listen to the Republicans, EVERY Senate Democrat voted to support the provision that is causing havoc for American families with millions of people losing their access to their preferred insurance plans. Thus, they are complicit in the President’s lies or deceptions that if you liked your current policy you could keep your current policy. That options was snuffed out three years ago by every Senate Democrat and not a single one of them had enough integrity to warn America about the impending doom, a doom predicted by Senate Republicans.

5) Again, when NBC comes down hard on this administration you know they really laid an egg. The following link puts to video clips side by side. The first clip is the President emphatically declaring that if you like your current insurance policy, you can keep it under Obama care. 

The second clip is about a small business owner who saw his health insurance costs go up 400% since he now must buy an Obama Care policy that provides maternity health care for his 59 year old wife. Just another  bit of stupidity and no one thinking through what was actually in Obama Care:

6) It is so pathetic when politicians realize they screwed up and could lose their access to the best and most cushy job in the world, that of being a U.S. Senator. Politico reported on October 30, 2013  that Louisiana Senator Landrieu would introduce a measure that would allow Americans to keep their health insurance coverage amid a flurry of reports documenting that hundreds of thousands of people have been told that they will lose their plans because of Obama Care. 

“The promise was made, and it should be kept,” said the good Senator. “And it was our understanding when we voted for that bill that people when they have insurance could keep with what they had. So I’m going to be working on that fix.”

Two problems her, Senator. As we discussed above, three years ago you voted against a Republican provision that would have avoided this mess altogether. You blew that chance and now about 3.5 million Americans have already lost access to their preferred plans. 

Second, just this past August, at an event sponsored by the Southwest Louisiana Chamber of Commerce, you publicly stated: “If I had to vote for the bill again, I would vote for it tomorrow.” So what happened between August and now? What changed such a dramatic turnaround? Oh, that’s right, your 2014 reelection hopes have taken a gigantic hit because of the unfolding disaster that is Obama Care. Talk about a hypocrite.

7) In closing today, I directly lifted some talking points from an October 31, 2013 analysis by the Heritage Foundation. Their article pointed out hat there are at least four other brewing Obma Care disaster besides the currently exploding disasters of Americans losing access to their preferred doctors, their preferred health insurance plans, and the fact that many are seeing their deductibles and premiums going up substantially in cost.

As Heritage points out, these four other disasters were predicted years ago but no one in this administration took them seriously but they have now arrived on the doorsteps of tens of millions of Americans:

1. Back-Door Public Option: You might have thought it was killed off, but an ugly embodiment of the public option is alive and well in Obamacare. Health expert Robert Moffit pointed out in 2011 that the Office of Personnel Management (OPM) next year will administer at least two nationwide health plans that will compete against private insurance. OPM is responsible for these plans’ pricing, profits, and operations.

These government-sponsored plans are the only health plans that can compete nationwide under a new set of rules, giving them an unfair advantage in an already disrupted health insurance market. “Instead of fair competition with private health plans, Congress is sponsoring the equivalent of a national monopoly,” Moffit wrote.

2. Illegal Subsidies to Congressional Members and Their Staffs: Keep in mind, OPM is the same agency that recently ruled members of Congress and their staffs can buy health insurance in the Obamacare exchanges and use a large, tax-free subsidy that exists for federal workers who get their coverage under the Federal Employees Health Benefits Program (FEHBP). Sure, the federal government doesn’t have actual legal authority to pay for federal workers in a health plan outside of plans contracted by OPM. But when has that stopped this Administration from creating special rules that flout the law’s language?

3. Cancellations in Employer-Sponsored Insurance: Much of the recent media focus is on cancellations for customers with individual insurance plans, but Heritage, the Congressional Budget Office, Deloitte, McKinsey & Co., and other organizations have warned for years that businesses will drop health coverage for their employees and dump them onto the federal health exchanges. With higher health costs, it will be cheaper for many companies to pay Obamacare’s employer mandate fine rather than pay for expensive, government-mandated health plans.

The scenarios vary, but anywhere from 5 million to 35 million hard-working Americans could lose their current health plans—and face the same plight of many customers forced to deal with a glitch-ridden website to buy plans on the Obamacare exchanges. A big reason why this hasn’t materialized yet is the Administration’s recent decision to delay the employer mandate until 2015.

4. Perverse Incentives That Hurt Low-Income Workers: The employer mandate delay hits the pause button on another expected setback for lower-income workers—mainly pricing them out of full-time employment. Labor expert James Sherk warned in 2011 that after paying for new health premiums, the minimum wage, payroll taxes, and unemployment insurance taxes, hiring a full-time worker would cost at least $10.03 an hour. With full-time family health plans easily costing $13.75 an hour, companies would lose money by having full-time workers with low productivity rates. Therefore, less-skilled workers would be at more risk for having their full-time jobs replaced with part-time ones.

Enough for today, but more disasters Obama Care tomorrow.

Part 6, August, 2013 Obama Care Update: Main Stream Media Finally Recognizes the Disaster, Major Unfinished Operational Tasks, and More

Okay, apologies up front. Over the past six days we have been examining and reviewing the many disasters and fiascoes that were spawned as a result of Obama Care. One would have thought six days would have been enough.

We reviewed the long list of root causes underlying our high health care costs and how Obama Care addresses almost none of them.

We reviewed how Obama Care is causing American workers to lose salary hours, reducing their take home pay.

We reviewed how Obama Care is causing business owners to pull back on hiring and business expansion, stunting overall economic growth in the country.

We  reviewed how the  underlying systems to support the rollout of some major components of Obama Care are far behind schedule and are likely to not be ready when scheduled.

We reviewed how the inadequate training of Obama Care “navigators” and the inadequate data systems security protocols will turn Obama Care’s processes into an identity thief’s paradise.

We reviewed how seven million Americans, per the Congressional Budget Office,  are likely to lose access to their current health care insurance programs, the exact opposite of what Obama Care was supposed to do.

We reviewed how Americans are likely to experience severe sticker price shock when they see how substantially higher their health care premiums are going to be under Obama Care.

We reviewed how smaller hospitals are likely to see severe economic days as Obama Care raped the Medicaid and Medicare budgets to fund its own processes.

We reviewed how every reputable opinion poll over the past few weeks has shown that the majority or at least plurality of Americans see Obama Care as a bad thing, respondents think that they will end paying more for health insurance, and are scared about losing their current health insurance options.

We reviewed how Obama and other politicians are illegally changing aspects of the legislation without going back through the proper legislative Congressional approval of those changes.

And after all of this review, we still have not covered all of the problems, given the new problems that have arisen just in the past week or so. Rather than wait until next month when we do another set of reviews, we thought it was important to get the following insanity out there for your review and depression:

1) The family of NBC news outlets have always been the most biased in their reporting when it comes to Barack Obama. They often come off as just another arm of the President’s public relations department. Thus, when someone like NBC News airs a news segment that is critical of Obama Care you know that it must be a bad piece of legislation. Consider the following quotes taken directly from the broadcast of such a piece on August 13, 2013:

  • The NBC Nightly News segment concluded that there would be adverse impacts of Obama Care on the people it intends to help, leaving some “with no insurance and a pay cut.”
  • Lisa Myers, a reporter involved in the segment, stated that NBC News “spoke to almost 20 small businesses and other entities around the country. Almost all said because of the new law, they’d be cutting back hours for some employees.” 
  • Additionally, a top union head told NBC News:”Wait a year, and you’ll see a tremendous impact as workers have their hours reduced and their incomes reduced.”

So, NBC News has found that Americans, small businesses, and unions do not like and fear Obama Care. These are the entities that are most likely to be impacted by the legislation so someone in Washington should be heeding their opinions before this disaster hit’s the proverbial fan.

2) Unfortunately, it appears that many people in the Obama administration are NOT heeding these opinions. In the same NBC News segment, Jason Furman, who is a  top economic adviser to President Obama, said that he “sees no systematic evidence” that the health-care law is “having an adverse impact on the number of hours people are working.

No disrespect to Mr. Fruman, let’s give him the benefit of the doubt and say that this administration made him deny the reality that has been in the news, and reported in this blog, for at least the past two years. We have discussed the many businesses and government entities that have issued press releases or held news conferences announcing how they were cutting workers hours and cutting the number of jobs they could be filling all because of Obama Care.

To not be aware of these realities is very scary. It shows an administration that is either very out of touch with reality, does not want to know about reality, thinks that they can lie about reality, or really does not care what is happening to American workers. In any case, their actions are irresponsible and despicable.

3) Previously, we had discussed the fact that legal cases against Obama Care were moving forward and that many of them, according to experts, had merit and a real chance of succeeding. One of the suits, filed by the Oklahoma attorney general, made it through a major milestone this week when that attorney general, Scott Pruitt announced: “The court rejected the federal government’s argument that Oklahoma lacked standing to challenge the law, allowing us to proceed with this pivotal case. We’re optimistic the court will recognize what states have known for months that the IRS disregarded the law by making the large employer mandate effective in Oklahoma or in any of the 33 other states without a state health care exchange.”

Apparently, the legislation, as written and enacted, does not allow the Federal government to force itself, its tenets, and the IRS onto the 34 states that have rejected setting up their own Obama Care health insurance exchanges. The Supreme Court decision that said Obama care was legal also gave the states the right to opt out of the exchange process. Obama knows that if 34 states are not included in the overall Obama Care effort, the financials and momentum of the legislation collapses, which would be good news for America, bad news for Obama. The first step towards the potentially good outcome is in the books.

4) The American Action Forum website recently published a pictorial representation of what has to be done in the next 50 days to make Obama Care operational. Remember, these people have had three years to get ready for this major October 1, 2013 rollout. 

According to the website, fifty major tasks have to miraculously come together in just 50 days for this monstrosity to have any chance of working. Take a look for yourself of what still has to be done and ask honestly yourself if this is not truly a “train wreck” (Senator Max Baucus’s words) ready to implode (double click picture for a larger view):


















5) Consider the following articles that major news outlets have written over the past year or so and then decide if this fiasco has any chance of reducing costs, expanding coverage, or actually working, three years after they started working on its rollout:

Consider some of the words that the mainstream press are using to describe what is happening: train wreck, costing jobs, delays, costs to rise, fret, fears, angry, unaffordable, destroy, skeptical, confused, etc. Even if you do not believe me, check out some of these articles to find others’ pessimistic outlooks on how bad this legislation is going to be. Apparently everyone sees the train wreck coming but those that work in the White House and this administration.

That’s enough for today. But tomorrow is another day where I promise it will be the end of the bad news from Obama Care… for this month.
