March, 2014 The Unfolding Disaster That Is Obama Crae, Part 7: Losing Access To The Best Hospitals, Prostate Cancer For Women, Is Harry Reid Now Lying?

This is our seventh and hopefully last, update this month regarding the unfolding disaster that is Obama Care. It is not that we have covered all of the latest disasters, we are just getting too depressed talking about how this piece of horrid legislation is affecting the financial and economic health, along with the freedom, of just about every American. Even if we finish up today, you can be sure that this time next month we will be going through a new round of fiascos and insanity being spawned from Obama Care.

1) A March 18, 2014 Associated Press article had some very depressing news for current and potential cancer patients who have enrolled in Obama Care health insurance policies:
  • Some Obama Care insurance policy holders may not be able to access to some of the nation’s top cancer hospitals since those facilities are not on their insurer’s approved list of options, according to a survey of nineteen cancer centers throughout the country.
  • For example, Seattle Cancer Care Alliance is not included by five out of eight insurers in Washington state's insurance exchange.
  • The MD Anderson Cancer Center says it is included in less than half of the Obama Care plans in the Houston area.
  • World famous Memorial Sloan-Kettering is included in just two of nine Obama Care insurers in New York City.
  • Only four of 19 of the cancer centers that responded to the AP survey claim patients have access through all the Obama Care insurance companies in their state exchanges.
  • The article points out that up until recently, all insurance companies would have wanted to give their customers access to the best cancer hospitals in their states but now, Obama Care has shifted the focus from medical care to cost containment and many of these best cancer centers are more expensive.
  • "This is a marked deterioration of access to the premier cancer centers for people who are signing up for these plans," said Dan Mendelson, CEO of the market research firm Avalere Health, since the focus is on costs.
  • Distressing for cancer patients is that many of these patients may not be able get access to the most advanced treatment, including clinical trials of new medications.
  • Adding insult to injury, according to the article, it is not easy for consumers shopping online in the Obama Care new insurance markets to tell whether the best cancer medical institutions are included in an Obama Care insurance plan.
  • To really add insult to injury, the article also points out that the government-subsidized private plans on the exchanges typically offer less choice than Medicare or employer plans.
Thus, there is some good news about cancer from Obama Care. Previously, a cancer diagnosis could make a person uninsurable. Now, insurers can't turn away sick people with health problems or charge them more. Lifetime dollar limits on insurance policies, once a death sentence, especially for cancer patients, are also banned.

But, as we have pointed out previously in our Obama Care reviews, the good news is that you have health care insurance, the bad news is that you cannot health care treatment. By never resolving and attacking the root causes of our escalating health care costs, the Obama Care legislation allowed the accounting industry to take over the health care industry. And costs and profits now drive the health care process rather than doctors and patients driving the health care process.

To keep insurance premiums low, insurers have designed narrow, and less expensive, networks of hospitals and doctors. And as a result, the same design process has also narrowed the range and depth of potential treatment scenarios for cancer patients. By not including a top cancer center an insurer can cut costs even if it sub optimizes treatment.

The AP article also points out a more insidious insurance company aim. By excluding the top cancer treatment options out of its hospital list, the insurance company may also protect itself from risk, slyly implying to cancer survivors or people with a strong family history of the disease that they should look elsewhere for the best treatment, minimizing the insurance company’s list of high potential and high cost cancer patients.

This is what happens when you to not fix the real cause of a problem, in any walk of life. The problem persists and you have to look for other ways, other short cuts to minimize the ongoing issues with the true root causes. And that is all Obama Care is, a Rube Goldberg short cut process that resolves nothing, it just moves around the risk and costs without reducing either.

2) It is often very scary when politicians speak and you realize that great swaths of your life and well being are dependent on them being intelligent, informed, and not ignorant of the issues. Unfortunately, as it often happens, this was not the case relative to a North Carolina state government politician, Verla Insko. In public and during a televised hearing of a state Senate proceeding regarding Obama Care, Ms. Insko proved to be possessing none of these attributes.

During the state Senate legislative hearings on Obama Care, she asked about the percentage of prostate cancer patients that were women: "What percent of the prostate cancer patients are women?" She asked this question of Duke University research scholar Chris Conover during the hearing in Raleigh.

"I have no idea," Conover replied, as people in the room began laughing.

"I would guess zero," he added. "But I don't know that for sure."

Ms. Insko, probably decision maker on health care matters in the state of North Carolina, did not now that prostate cancer is strictly a male problem. And she is in a position of power to decide the health care needs of residents in that state. Insane.

3) We have asserted any number of times in this blog that Obama Care and its ineptness could end up killing Americans who otherwise would have had longer lives in the absence of Obama Care. A recent investigative article from the Las Vegas Review-Journal newspaper was summarized in a March 18, 2014 on the Bankrupting America website:
  • Larry Basich said he began trying to enroll into an Obama Care health insurance policy in Nevada on Oct. 1, 2013, the day the exchange website went live.
  • Like most Americans trying to use the Obama Care health exchange websites, he had to overcome technical flaws during multiple sign-up attempts.
  • Finally, in mid-November, six weeks or so after he started the sing up process, he finally got through the morass and chose his plan: UnitedHealthcare’s MyHPNSilver1.
  • His description of the process: “It was like reaching the third level of Doom.”
  • Basich paid his first premium on Nov. 21, 2013 and within days, the Obama Care health exchange withdrew the $160.77 monthly premium payment from his money-market savings account.
  • According to the Journal-Review, because Basich paid a month before the Dec. 23 deadline, his Obama Care insurance coverage was to commence on Jan. 1, 2014.
  • However, as the weeks ticked by in late 2013, Basich received nothing to confirm he actually had health insurance except for the fact that someone had taken his money.
  • Nevada Health Link, the state Obama Care exchange, kept telling him he was enrolled, but UnitedHealthcare said he wasn’t in their system and thus, they were not covering him.
  • Unfortunately, Basich’s predicament went critical on Dec. 31, when he had a heart attack.
  • His post heart attack treatment, which included a triple bypass on January 3, 2014 resulted in $407,000 in medical bills in January and February that no insurer is covering and for which he is constantly getting sent bills to pay.
  • In the meantime, the Obama Care exchange has billed and collected premium payments from his account for the months of January and February even though the insurance company still says he is not covered.
  • This whole mess has resulted in everybody getting involved, from the insurance company to the people operating the health exchange to his insurance agent to representatives from Nevada Senator Harry Reid’s office, with nothing being resolved. [Note: this is the same Harry Reid who in late Febraury claimed that ALL Obama Care horror stories were untrue. I think this qualifies as a horror story in the Senator’s home state.]
  • The only thing Baisch knows is that everyone agrees that his Obama Care health insurance coverage will begin in April, almost four months after he started making Obama Care payments, and which he continued to make, for insurance he expected to have started nearly three months ago, coverage that was promised to him by the exchange.
What a mess and stress to put on an American who is trying to remain stress free and recover from a serious heart problem. But apparently he is not the only American or Nevadan suffering through similar trials and tribulations.

The Bankrupting America website piece, which excerpted information from the newspaper article, refers to a Ms. Burch who apparently owns or works for an insurance brokerage firm called Branch Benefits Consultants. She asserts that Mr. Basich is not unique:
  • Burch estimates that of nearly 200 Branch Benefits Consultants client sign ups via Nevada Health Link for Obama Care polices, only 5% have gone through problem-free.
  • More than 20 of her customers experienced the same plan-selection issue as Basich.
  • One client chose an effective coverage date of March 1. Her insurance card showed an effective date of Jan. 1. Burch said that when she called to fix the issue, a customer-service rep told her the system showed a start date of April 1.
  • With the March 31 enrollment deadline looming, Burch states that she still sees other widespread enrollment problems, including frequent website error messages, incorrect Federal government subsidy calculations, payments missing within the Obama Care data systems despite clients’ canceled checks, and incorrect effective coverage dates.
What a mess and an unfolding disaster for every American. We are going to cap this month’s string of disaster reviews at seven days. However, rest assured, at this time next month there will be another string of disasters from the worst piece of Washington legislation ever written.

December, 2013, The Unfolding Disaster That Is Obama Care Update, Part 3: Nullifying Obama Care At The State Level, No Access To Top Hospitals and Other Smack The Mole Failues

This is a third in what is likely going to be a long series of updates and analyses of the unfolding disaster that is Obama Care. We have been doing these mini-series every month for the past four months for the simple reason that this legislation is so bad, that the bad news from its rollout just keeps on coming.

Millions of Americans are losing their jobs, their current insurance policies, access to their favorite doctors, access to their preferred hospitals, and possibly access to life saving drugs not covered in their Obama Care insurance policies. The monthly premiums are generally much than they were prior to Obama Care’s rollout and the deductibles are also escalating dramatically. The President’s promises that you can keep your insurance policy, your doctors, and your hospitals is turning out to be either the biggest lie in Presidential history or the biggest piece of ignorance about what was supposed to be his landmark legislation.

Today’s insanity from Obama Care includes the following updates and crises:

1) Yesterday, we talked about the effort in the South Carolina state government to “nullify” an impact of Obama Care in the state of South Carolina. A piece of legislation to that effect has already passed in the House part of the state government, the state Senate will take it up early next year and if the Senate passes it, it will likely be signed by the Republican governor.

Well, it turns out that a trend might be starting to terminate the legislation since four state legislators in Georgia have introduced legislation in that state to do the same nullify action as South Carolina:
  • “The bill’s main thrust is to prohibit state agencies, officers and employees of the state from implementing any provisions of the Affordable Care Act, leaving implementation entirely in the hands of the federal government, which lacks the resources or personnel to carry out the programs it mandates,” said Rep. Spencer in a press release.
  • Again, I am not a Constitutional lawyer or expert by an stretch of the imagination so I have no idea if this is a valid state government tactic to use. However, apparently this nullify option is a long-standing legal principle, the so-called anti-commandeering doctrine, and thus some in the legal profession think that both states’ nullify efforts are on strong legal grounds.
  • In four major legal cases from 1842 to 2012, the Supreme Court has consistently held that the Federal government cannot “commandeer” states, forcing them to enforce or expend state level government resources to participate in Federal law or regulatory programs.
So who knows, maybe the Constitution will save us from this disaster after all.

2) According to a recent analysis from the folks at Americans For Tax reform:
  • Health and Human Services Secretary (HHS) Kathleen Sebelius recently provided an updated dollar amount for the cost of HealthCare.gov in Congressional testimony: $677 million.
  • In addition to the $677 million spent on the Federal Obama Care website, the Centers for Medicare and Medicaid Services (CMS) have already paid out a whopping $4.5 billion of taxpayer money to promote Obama Care on the state level.
  • HHS also provided updated Obama Care enrollment results: 364,682 Americans have “selected a plan” from the Obama Care exchanges, the equivalent of putting an item in your online shopping cart and leaving it there.
  • Doing some simple math, we find that the taxpayer cost per potential “enrollee” is over $14,000 per potential shopper ($4.5 billion + $677 million = $5,177,000,000 ÷ 364,682 = $14,196)
  • $14,000 to get one person interested in Obama Care. However, interest so far is not actually policy confirmation. Many of these people have not yet paid for the policy they may have selected on the exchange so there may be some “slippage,” i.e. people do not follow through and actually close the deal. In the presence of slippage, the cost per person would actually go higher than the obscene $14,000 per person.
  • In fact, other news sources are saying only 30,000 people have actually paid for their Obama Care insurance policies vs. 365,000 of so who indicated they would. Thus, the cost for an actual paying Obama Care policy is more than ten times higher than the $14,000 (364,682 divided by 30,000 equals about 12).
How many businesses would be able to survive if the cost of acquiring a customer was hundreds of thousands of dollars? Not many but that is what the Obama Care legislation has cost us so far, billions of dollars for thousands of customers. Pathetic.

3) In a November 28, 2013 article we found out that the Obama administration was pushing back the ability of small businesses to comparison shop for small business Obama care insurance policies for twelve months because the government website to do so is still busted.

One of the main selling points of Obama Care several years ago was going to be the ability of small businesses and their employees to get reasonably priced insurance via small buisness Obama Care exchanges. Due to gross incompetence of the Federal government, another Obama Care promise is broken and delayed. However, given how bad the non-small business/personal insurance side of Obama Care is turning out to be (lost coverage, lost access to favorite doctors, hospitals, and needed medicine) maybe American small businesses should be grateful for the broken promise.

4) According to a document put out by the Health And Human Services (HHS) Department in mid August, the Federal government is looking up to spend $7 billion dollars to find ways to reduce government incurred medical costs and expenses:

The purpose is to develop a Research, Measurement, Assessment, Design, and Analysis (RMADA) IDIQ [Indefinite Delivery, Indefinite Quantity] to respond to expanded needs of the Patient Protection and Affordable Care ACT (ACA) and Health Care reform ACT (HCERA). The work awarded under the RMADA will involve the design, implementation and evaluation of a broad range of research and/or payment and service delivery models to test their potential for reducing expenditures for Medicare, Medicaid, CHIP, and uninsured beneficiaries while maintaining or improving quality of care.

But weren’t we told that Obama Care by itself would reduce the cost of insurance policies, the cost of medical care, and the national debt by itself? Weren’t those the promises? Then why are we spending an incremental $7 billion (about $60 for every U.S. household) to do what Obama Care was billed to do? Something sounds very fishy or hypocritical or deceptive, or….take your pick of insanity.

The actual HHS call for quotes can be accessed at:

5) Two more stories were recently published by the Associated Press verifying that many insurance policies and companies working through the Obama Care exchanges are restricting access to some of the best doctors and hospitals in the country in order to reduce costs. The first story was about the Obama Care exchange policies in New York state, as described by the AP article:
  • New Yorkers buying a health plan on the state’s new insurance exchange should read the fine print if they’re interested in getting care at some of the city’s top hospitals.
  • Not all are participating in the new plans created by Obama Care.
  • As of early December, not one of the plans for sale on New York’s health benefit exchange would cover treatment at Memorial Sloan-Kettering Cancer Center, one of the world’s largest and most respected cancer hospitals.
  • That could mean that the 615,000 individuals and 450,000 small business employees expected to eventually get their insurance through the exchange would have to go someplace else for treatment, or pay the bill out of their own pockets.
  • Other premier city hospitals are in the networks of just a few of the new plans.
A similar but slightly different situation was reported by the AP out in Washington state. While some hospitals are opting not to serve Obama Care insurance policies like Sloan Kettering in New York, in Washington, in order to keep costs down, it is the insurers that are preventing some world class medical facilities from being available in the Obama Care insurance policies:
  • The Obama administration made it a priority to keep down the cost of insurance on the exchanges, the online marketplaces that are central to the Affordable Care Act. But one way that insurers have been able to offer lower rates is by creating networks that are far smaller than what most Americans are accustomed to.
  • The decisions have provoked a backlash. In one closely watched case, Seattle Children’s Hospital has filed suit against Washington’s insurance commissioner after a number of insurers kept it out of their provider networks. “It is unprecedented in our market to have major insurance plans exclude Seattle Children’s,” said Sandy Melzer, senior vice president.
  • The result, some argue, is a two-tiered system of health care: Many of the people who buy health plans on the exchanges have fewer hospitals and doctors to choose from than those with coverage through their employers.
  • The last AP paragraph from the Washington state example starts to explain what will able happen in this country as a result of Obama Care. The more affluent, the wealthier people in this country will continue to have access to the best doctors the best facilities the best health insurance policies (e.g. gold, platinum), the full array of medicine. The rest of us will devolve down to the more cut rate doctors and hospitals, the more limited access to needed drugs and medicine, and less robust insurance plans (e.g. bronze and Medicaid).
This all because the Obama Care architects and writers never understood the root causes of the high health care costs in this country:
  • Americans are obese.
  • Americans eat too much of the wrong kinds of food.
  • Americans do not exercise enough.
  • Americans smoke too much.
  • Americans are getting older on average, resulting in more age related diseases and health care costs.
  • There is a significant need for tort reform in the medical industry.
  • There is a significant need to allow cross state border insurance company competition.
  • There is a critical need to cut down the $100 billion worth of taxpayer that is paid out in criminal fraud and waste every year.
Obama Care never really addressed these root causes, the resolution of which would take major costs out of the health care business in this country. Instead, the have contrived a Rube Goldberg-like health insurance hidden ball trick that only moves costs and expenses around within the industry, not reducing the overall levels of costs and expenses.

It’s like playing the “Smack The Mole” game at your favorite arcade. You can smack down a cost mole in one area but those costs just appear again somewhere else on the board. Smack down those costs, and another cost mole sticks his head up. As a result, we start to see the bifurcation of health care with the rich getting better care and the rest of us getting worse care.

The cost moles and other calamities of Obama Care will pop their heads up again tomorrow as we continue to review the worst piece of legislation ever enacted by the most inept set of politicians Washington has ever seen.

December, 2013, The Unfolding Disaster That Is Obama Care Update, Part 1: Website Still Stinks, Doctor Shortages, Doctor Boycotts and More

This post starts the now monthly review of the unfolding disaster that is Obama Care. Unfortunately for America, we have had to devote more and more attention and posts to this subject over the past four months as the negative ramifications of the legislation’s rollout and inner demons have become so obvious.

In each of the past three months we have had to use multiple days to cover all of Obama Care’s insanity. The first post in the August series can be accessed at:

The first post in the September series can be accessed at:

The first post in the October series can be accessed at:

As a result of these previous, in-depth analyses and reviews, this month will focus more on the bad news than the analysis and research behind the bad news. We do that for two reasons:
  1. First, we have already laid out the reasons why Obama Care can never be successful: it never researched and understood the underlying root causes of our high health care costs in this country. Without understanding root causes, the chances of actually resolving the true issues are next to nothing.
  2. Second, we are currently looking at over 200 articles and analyses that prove Obama Care is a disaster. To repeat previous analyses and research would not allow us to make much of a dent into the ever growing failures. Thus, we will focus on news, not analysis, this month since the analysis discussed in preivous months; posts are unchanged.
So, let’s get started and see what evil and failure Obama Care has created in just the past four weeks or so:

1) One of the most visible disasters of Obama Care has been the website that prospective customers of Obama Care’s exchanges were supposed to be able to easily logon onto to and easily find health insurance policies that fit their needs. Most everyone in the country by now knows that the website process and experience has been an utter disaster with security breeches, website unavailability, and other problems.

How bad has the website experience been, keeping in mind that the Obama administration had three years and had spent well over a whopping $600 million to develop? According to a recent Gallup survey 63% of those uninsured Americans who have visited an Obama Care website described the experience as negative or very negative. Three years, $600 million spent and nearly two out of three people found the experience distasteful. Pathetic job of simple website development.

2) One of the major intentions of Obama Care was to get millions of uninsured Americans into health insurance policies. However, the logic of the legislation failed a basic and simple reasoning test: if millions of Americans now have health insurance they are more likely to use their health insurance options.

But if no provisions are made to increase the number of doctors to handle the millions of more potential customers, you are going to have a problem. It is a simple law of supply and demand. Increasing the demand while doing nothing to also increase the supply will result in shortage of supply and likely higher costs due to higher demand. And higher health care costs is the exact opposite of what Obama Care is supposed to do.

This fact of life was driven home by a recent Wall Street Journal article that was reviewed in the November 15, 2013 issue of The Week magazine. According to the article, the U.S. will likely be short 150,000 doctors by 2028, about 3,000 doctors per state on average. More importantly and distressingly, most of the shortage will be with primary care physicians, those doctors that people are most likely to want to see under their health insurance plans but who generally make far less money on average than medical specialists.

Which again illustrates a point we have made over the past few months: just because you have health insurance in the world of Obama Care does not mean you have adequate or any kind of health care, given what is likely a doctor shortage crisis that the writers of Obama Care were never smart enough to understand. The operation was a success (i.e., you have health insurance coverage) but the patient died (i.e. you could not get in to see a doctor).

3) Speaking of doctors shortages, consider what is going on in California. According to a recent Washington Examiner article, estimates say that a whopping 7 out of 10 California doctors will not participate in the Obama Care exchange in California because the insurance payments for services provided in exchange health care policies are too low.

Details from the article include the following:
  • “It doesn’t surprise me that there’s a high rate of nonparticipation,” said Dr. Richard Thorp, president of the California Medical Association, a group that represent about 38,000 of the 100,000 or so California doctors.
  • In September, less than a month before the exchanges went live, the California Obama Care exchange announced that doctor payment schedules will be linked to the state’s Medicaid rates, some of the lowest rate schedules in the country.
  • For example, in other states, Medicare pays doctors $76 for return-office visits. However, in California, Medi-Cal’s reimbursement is $24, according to Dr. Theodore M. Mazer, a San Diego ear, nose and throat doctor. This is the rate, $24, that the Obama Care insurance policies will be pegged to.
  • In other states, doctors receive between $500 to $700 to perform a tonsillectomy. In California, they get $160.
  • As a result, vast number of doctors will not become part of the Obama Care exchange doctors’ networks or will retire out of frustration, according to doctor quotes in the article.
  • Dr. Theodore M. Mazer, a San Diego ear, nose and throat doctor is quoted in the article asserting that he knows of NO ONE in his area of expertise that has signed up to be part of the Obama Care exchange in California: “I cannot find anybody in my specialty in the area that has signed a contract directly with any of these plans.” Thus, if you live in California and rely on an Obama Care health insurance policy, try to make sure that you never get an ear, nose or throat affliction because your policy may not give you access to the right type of medical specialist.
  • Mazer is one of those many, older California doctors who is thinking about retiring early as a result of Obama Care: “I just turned 55, and a lot of us are kind of going, ‘Maybe there’s something else we can do in the last 10 years,’ because this is just getting too onerous to keep on going.”
  • As an additional insult, many doctors quoted in the article assert that their names were listed with the Obama Care exchange policies as being affiliated with those policies when in fact they had never signed up.
What a mess and another example of the adage: The operation was a success, (i.e. people got health insurance) but the patient died (they could not see a doctor who honored those policies.)

Of course, these lower reimbursement rates of Obama Care policies in California are an attempt to make those policies more affordable. But the creators of Obama Care never understood basic economics, namely that reducing the price you pay for a service discourages providers of those services.

Thus, while the policies might look good and affordable up front, trying to actually use the promises in those policies will be the real challenge and danger in times of illness because the affordability of the policies dried up the servicers of those policies, i.e. it created acute doctor shortages.

4) The same flawed reasoning that is leading to limited access to the tope doctors and medical specialists is also being applied to the top hospitals and medical centers across the country, with the same results: severely reducing the hospital reimbursement levels for Obama Care insurance policies is resulting in top echelon hospitals not being part of the policies and not being accessible to those who buy those policies.

This was vividly illustrated in a recent Financial Times investigation. The Times found that Americans who are Obama Care online exchange policies will have limited access to some of the nation’s leading hospitals, including two world-renowned cancer centers.

This lack of access is caused by the drive by Obama Care insurers to limit costs. As examples, the Times report found that the majority of insurance plans being sold on the new healthcare exchanges in New York, Texas, and California will not provide access to Memorial Sloan Kettering in Manhattan and MD Anderson Cancer Center in Houston, two top cancer hospitals, or Cedars-Sinai in Los Angeles, one of the top research and teaching hospitals in the country.

The Times article pointed out two very real downsides of what Obama Care is doing to hospital access:
  • Frustrated consumers could then begin to realize what is not always evident when buying a product as complicated as healthcare insurance: that their new plans do not cover many facilities or doctors “in network.” In other words, the facilities and doctors are not among the list of approved providers in a certain plan.
  • Under some US health insurance plans, consumers can elect to visit medical facilities that are “out of network,” but they would probably incur high out of pocket costs and may need referrals to prove that such care is medically necessary
  • Thus, if someone has to pay additional money to see the right type of doctor or hospital, doesn’t that negate the whole principle of lowering health care insurance and medical costs? Most people cannot preordain what kind of sickness or disease they get, opening themselves up to much higher medical costs if the limited number of doctors or hospitals they are allowed to see does not handle their kind of malady.
So let’s review: Obama Care does nothing to cope with the increasing availability of health care access but the dramatically number of fewer doctors available in the country. Obama Care is limiting the number of doctors, including medical specialists, you can see, to reduce costs. Obama Care is limiting access to top hospitals, forcing Obama Care customers into possibly inferior facilities and treatment options, just to reduce costs without regard to health care quality. Oh yeah, the website still stinks.

As we have said many times before, Obama Care is a bad approach to providing health care insurance to millions of Americans. It is an even worse way to provide actual health care to millions of Americans. Under this legislation, health care insurance does not guarantee you access to quality health care or any health care at all, given the dire doctor shortage. More bad news tomorrow… and the next day, and the next day….
