The Race To Bankruptcy Court: New Jersey Also Coming On Strong

Let’s take a brief break from our run of posts regarding the massive corruption and fraud in government programs and return to one of the hottest topics we have been covering over the past few years, coverage that has intensified recently: which major city or state government will get to bankruptcy court first? Our primary cities in the race to bankruptcy include New York City, Chicago, Los Angeles, San Francisco, and newcomer, Seattle. The state governments that we think are soon heading into bankruptcy include New York, New Jersey, Illinois, and California with Washington state a newcomer to the race.

The reason for returning to this topic in the midst of our corruption series is because there have been some significant developments in the race to bankruptcy court. However, before reviewing the latest news and seeing which state or city is making the best progress towards government bankruptcy, let’s review how these cities and states got themselves into this financial death spiral position to begin with:

  • A government entity keeps expanding its budget, eventually putting pressure on the tax revenue stream it receives.
  • At some point, rather than cut government spending or make its programs more efficient financially, the politicians in charge raise taxes to meet the ever growing government expenditures.
  • The raising of taxes causes some residents and businesses to leave the city or state for less tax burdensome areas, reducing the tax base and reducing the revenue stream.
  • Rather than cut expenses and become more efficient to match the reduced tax revenue stream, politicians in the above cities or states raise the tax burden even more.
  • This causes more residents and businesses to flee the city or state, further reducing the tax base and tax revenue stream.
  • At some point politicians panic and raise taxes more and start cutting vital government services (e.g. police, fire, education) in order to try and balance government spending against the shrinking tax base and revenue stream.
  • The reduction in quality of government services in particular and quality of life in general drives more residents and businesses out of the area.
  • Eventually, the expenses, costs and financial liabilities outstrip the reduced tax stream and bankruptcy occurs.
Okay that’s the process, now lets check the progress some of the above listed government entities are making to achieve this bankruptcy goal against this process:

1)Our previous post discussed the great progress Seattle and its mayor are making in the race to bankruptcy court. And while Seattle has entered its own financial death spiral, New Jersey politicians have not been sitting idly by as they also have been driving companies and tax base out of their state:
  • Samsung Electronics recently announced that it is moving a significant portion of its instate employee base out of New Jersey and moving to state income tax free Texas.
  • The move would take about 1,000 company workers out of New Jersey.
  • Samsung had been operating in the state since the 1980s.
  • According to a company release: “Samsung Electronics America Inc. is undergoing a business transformation designed to better position our organization for long-term growth and future success. As part of this effort, we are relocating our US headquarters from New Jersey to our existing campus in Plano, Texas, building on our 30-year presence in the state.”
  • This out migration comes less than a year after the company opened up a new headquarters campus in New Jersey.
  • The New Jersey Business & Industry Association issued a statement that reinforced the perception that New Jersey is not an easy operating climate for businesses, urging the state political class to ease regulations, cut red tape, and make the state more attractive to businesses.
  • Statements from the company were typical business nonsense, talking about realigning priorities, focusing resources in one location, etc.
Not mentioned in the company releases was the reality that New Jersey has some of the highest personal and business taxes in the country, a tax burden that eventually wears out people and companies, forcing them to find better financial conditions in states like Texas.

2)But Samsung is not the only major company moving business resources, employees, and tax revenue out New Jersey:

  • Budweiser recently announced that it is closing down one of its major historic breweries in Newark, New Jersey.
  • While Samsung had a very short major presence in the state, the Newark brewery was a fixture in Newark and New Jersey for 75 years.
  • The company also announced that it was selling the brewery property to a commercial real estate company that will likely convert the property to a warehouse facility.
  • The brewery had operated through wars, recessions, inflationary periods, the pandemic, hurricanes, and other man made and natural disasters.
  • But apparently it could not withstand the unfriendly and high tax environment of New Jersey.
  • 475 brewery employees either have to relocate to another out of state Budweiser brewery or look for other employment.
But none of this should be surprising since New Jersey:
  • Has the highest corporate tax rate in the country at 11.5%.
  • Has a 2.5% surcharge tax on the largest state employers.
  • Has the highest tax burden in the region as a percentage of personal income.
  • Has the second highest top personal income tax rate in the country.
  • Has one of the highest unemployment insurance tax rates in the country.
  • Has the worst business competitiveness rating in the region according to the New Jersey Business and Industry Association.
Tax and tax and tax and eventually people and businesses get smart and move to a better financial situation. And the situation is not expected to get better any time soon since the new governor has proposed a record-setting $60.7 billion budget for the state government even though her tax base is getting smaller by the day.

3)The website for radio station 101.5 recently did an excellent job in documenting how many jobs have been lost in the state since just the beginning of the year. Their review can be accessed at the following link:

https://nj1015.com/nj-job-losses-still-growing/

Some highlights of their reporting include the following:
  • More than 7,600 employees have been laid off since the beginning of the year.
  • These layoffs occurred in all sorts of businesses, including energy, retail, hotel, drug stores, and other business types.
  • ExxonMobil is leaving the state in order to reincorporate in Texas, ending a whopping 140 year presence in New Jersey.
  • ExxonMobil executives pointed out that Texas has no state income tax and lower business operating costs and regulations.
  • The number of Fortune 500 companies headquartered in the state has dropped from 22 in 2018 to 15 in 2025.
  • Other companies that have already moved operations and employees or intend to do so out of New Jersey include Verizon, Novartis, Johnson & Johnson, Prudential, JP Morgan Merck, Optum, and Acme supermarkets.
  • As the article points out, not only do business and employee tax resources leave but economic vitality and growth, charitable donations, and future growth opportunities leave also.
  • One state politician, Heather Simmons, understands the problem: "We grow revenue by growing our economy, not by raising taxes. There is increasing consensus, from the Governor’s office and colleagues in the Legislature, that new revenue must come from economic growth, not from raising taxes."
  • A simple concept but one that eludes most politicians in cities and states in a financial death spiral.
Detailed company layoffs and downsizing actions are listed in the link listed above but taste of what is in that article includes the following:
  • Verizon - 1,319 layoffs in Basking Ridge.
  • Bristol Myers Squib - 1,156 layoffs in Lawrence
  • Rite Aid Drugstores - 1,122 layoffs around the state, 16 store locations closed.
Just a sample of what is going happening to the tax base in the state.

Yes, Seattle is coming on strong in the race to bankruptcy. California as a state probably still has the state led in the race to bankruptcy. But New Jersey is deep into its own financial death spiral so they are definitely still in the running.

Government Gone Wild, Part 8: Three More NSA Whistleblowers Come Forward, Part One Of Their Tale Of Their Bravery

This is the ninth installment in a series on government snooping and the destruction of the Fourth Amendment as it pertains to the Federal government and the NSA’s confiscating just about every form of electronic communications of every American under the false guise of fighting terrorism. This Orwellian and creepy snooping has resulted in skyrocketing book sales of George Orwell’s dismal prediction of a future dictatorship in this country in the novel, “1984.”

In fact, you can still take the quiz that asks you to choose whether a certain aspect of government intrusion and spying is from Orwell or from the Obama administration at the following link:

http://www.loathemygovernment.blogspot.com/2013/06/government-gone-wild-part-4-orwell-or.html

The first installment in this seemingly never ending review of the Fourth Amendment destruction can be accessed at:

http://www.loathemygovernment.blogspot.com/2013/06/government-gone-wild-part-1-verizon.html

Today’s discussion focuses on three more NSA whistle blowers who have come forward to verify that the original whistle blower, Edward Snowden, who truly upended the apple cart of government snooping secrecy, was correct in his facts and in his actions to come forward as a concerned American who was scared about us losing our freedom and privacy to the Federal government.

This now brings the total number of outed whistle blowers on this administration’s secret surveillance of Americans to at least six. We have Snowden and the three new NSA whistle blowers. We have California Congresswoman Maxine Walters who publicly told the world in February that Obama had a giant database containing every American’s electronic communications. We also have Shia LaBeouf who told Jay Leno in a 2008 interview that an FBI movie consultant told him that the government was listening in on up to 20% of Americans’ phone calls, an assertion that is in complete conflict with President Obama’s claim that the government was NOT listening to our phone calls.

The claims and accusations made by the three new NSA whistleblowers are just as scary and dire as Snowden’s. They were interviewed together in a June 16, 2013 USA Today article and interview. The entire article can be accessed at:

http://www.usatoday.com/story/news/politics/2013/06/16/snowden-whistleblower-nsa-officials-roundtable/2428809/

Some of their more serious assertions and claims from the article are just as creepy and scary as Snowden’s:
  • Thomas Drake, William Binney and J. Kirk Wiebe worked for the National Security Agency for many, many years and actually were deeply involved in developing the very systems that are now snooping on every American without due process or cause.
  • According to the article, for years the three whistle-blowers had told anyone who would listen that the NSA collects huge swaths of communications data from unwary U.S. citizens with their audiences ranging from their immediate supervisors to Congressional committees to Federal investigators, and now the news media.
  • Although they had spent decades in the upper management levels of the NSA designing and managing the current data-collection systems, they are speaking out now because they now believe their systems and work have been turned against Americans.
  • Like Snowden and the brave State Department employees who spoke out because of the unnecessary murders of four innocent Americans at the Benghazi consulate, these three brave Americans have also been investigated as criminals and forced to give up careers, reputations and friendships built over a lifetime of serving America.
  • Drake: “And we are seeing the initial outlines and contours of a very systemic, very broad, a Leviathan surveillance state and much of it is in violation of the fundamental basis for our own country — in fact, the very reason we even had our own American Revolution. And the Fourth Amendment for all intents and purposes was revoked after 9/11. …” Comment: Destruction of the Fourth Amendment, as witnessed by insiders who were close to the mechanism that did the destruction.
  • Radack: “He [Snowden] is someone who exposed broad waste, abuse and in his case illegality. ... And he also said he was making the disclosures for the public good and because he wanted to have a debate.”
  • Binney: “Ever since ... 1997-1998 ... those terrorists have known that we've been monitoring all of these communications all along. So they have already adjusted to the fact that we are doing that. So the fact that it is published in the U.S. news that we're doing that, has no effect on them whatsoever. They have already adjusted to that.” Comment: Which gets to our position yesterday, do we really think that the terrorists are that stupid to use basic, unencrypted communications modes?
  • Drake: “I mean, it's [the Verizon secret court order to give up telephone information] the first time we've publicly seen an actual, secret, surveillance-court order. I don't really want to call it "foreign intelligence" (court) anymore, because I think it's just become a surveillance court, OK? And we are all foreigners now. By virtue of that order, every single phone record that Verizon has is turned over each and every day to NSA. There is no probable cause. There is no indication of any kind of counterterrorism investigation or operation. It's simply: "Give us the data." ... “ Comment: Scary observation and actual fact that we are now all “foreigners” in our own country.
  • Drake and Binney: “One is that the FBI requesting the data. And two, the order directs Verizon to pass all that data to NSA, not the FBI. What it is really saying is the NSA becomes a processing service for the FBI to use to interrogate information directly. ... The implications are that everybody's privacy is violated, and it can retroactively analyze the activity of anybody in the country back almost 12 years.”
  • Binney: “Now, the other point that is important about that is the serial number of the order: 13-dash-80. That means it's the 80th order of the court in 2013. ... Those orders are issued every quarter, and this is the second quarter, so you have to divide 80 by two and you get 40. If you make the assumption that all those orders have to deal with companies and the turnover of material by those companies to the government, then there are at least 40 companies involved in that transfer of information. However, if Verizon, which is Order No. 80, and the first quarter got order No. 1 — then there can be as many as 79 companies involved.” Comment: So the assertion by this administration that only top line telephone call information and only Verizon information was confiscated is probably bogus.
That concludes the first half of the story that these three brave whistleblower/American heroes told USA Today. We will conclude their stories and insights tomorrow along with our conclusions of what needs to be done to fix this liberty sapping situation.

Government Gone Wild, Part 2: Why We Do Not and Should Not Trust The Obama Presidency

Yesterday, we reviewed the latest scandal and attack on liberty by the Obama administration and the amazing and horrifying fact that the administration had secretly obtained a secret warrant from a secret court to get the details on the calling habits of millions of Verizon customers. The administration is trying to convince us that their obtaining every Verizon call will somehow make us safer and protect our freedoms even as our privacy is being grossly violated.

The details of our disgust and review can be accessed at:

http://www.loathemygovernment.blogspot.com/2013/06/government-gone-wild-part-1-verizon.html

Today, we will focus on notable quotes but failed promises from this President as it relates to the current and massive privacy intrusions by his administration and the subsequent lack of trust in any thing this administration says. The bottom line is why should we trust him and his administration now when his history of promising but always falling short or reneging on his promises is so strong.

Tomorrow, we will review a set of insightful tyranny quotes from people living today and in the past that will put this assault on the Constitution by the Obama administration into perspective. But before we do any of this, let’s set the stage:
  • As we reviewed yesterday, the government has obtained millions and millions of call log information from Verizon.
  • The administration has been using the IRS to harass, sabotage, and deny the rights of Tea Party and conservative Americans to exercise their freedom of speech.
  • The administration has been using the IRS to harass, sabotage, and deny the rights of various religious organizations to exercise their freedom of speech and freedom of religion.
  • The administration denied “life, liberty, and the pursuit of happiness” to about two dozen Americans during the siege of the U.S. consulate at Benghazi by denying rescue support during a terrorist attack, resulting in the unnecessary deaths of four brave Americans.
  • The administration was caught secretly obtaining and tracking down information on news journalists.
  • The administration has made a habit of denying Freedom of Information Act requests and viciously going after brave government whistleblowers who report government's illegal acts.
  • According to news reports from several weeks ago, the IRS apparently illegally obtained the health records of about 10 million Americans, including every California state judge, and now faces a California class action suit.
  • According to a recent Wall Street Journal article, the National Security Agency’s (NSA) monitoring of Americans includes customer records from the three major phone networks, not just Verizon, and also includes emails and Web searches, the NSA has also has confiscated and cataloged credit-card transactions records, and the NSA has also obtained data from Internet-service providers such as data about email or website visits, several former government officials said.
  • As if confiscating American’s electronic activities is not enough, Britain's Guardian newspaper, which broke the original story on the NSA snooping, has reported that it has seen documents showing how the British eavesdropping agency GCHQ has had access to America's "Prism" system since at least June 2010 and thus, had access to American citizens‘ calling habits.
  • At the behest of a Freedom Of Information Act request by the American Civil Liberties Union, the Department of Homeland Security has released a long-awaited 2011 assessment of the civil liberties impact of its policy of conducting “suspicionless” searches (i.e. the seizing and searching of American electronic devices within border areas without just cause, due process, or a warrant) of electronic devices at any U.S. border; not surprisingly, the ACLU calls the results of the DHS assessment “disappointing” for civil liberties advocates.
Okay, in the face of all these recently uncovered attacks on liberty, let’s look Obama’s record on quotes and trust (remember that for the first two years of his Presidency, President Obama‘s party had filibuster proof majorities in both the House of Representatives and the Senate, he and his party could have done anything they wanted from a legislative perspective):
  • "As President, I will close Guantanamo, reject the Military Commissions Act and adhere to the Geneva Conventions." Four years later, Gitmo is still open, the American taxpayer continues to pay billions of dollars to manage and expand the facilities there, long time inmates are in the midst of a hunger strike and forced feeding, and the President recently promised to again to close the facility but admitted he had no idea how to do it. Failed promise.
  • "After 18 months, our troops will begin to come home [in June 2011]… [O]ur troop commitment in Afghanistan cannot be open-ended – because the nation that I'm most interested in building is our own." Thus, this promise would have had most of our troops and financial resources out of the country by Afghanistan by December, 2012 if the President was able to hit the 18 month target. The U.S. military will be in Afghanistan at least until 2014, and possibly longer, along with the associated taxpayer cost. Troop withdrawals have been modest since these statements. Failed promise.
  • President Obama's stimulus package passed in 2009 and cost the American taxpayer over $800 billion. The administration boldly stated that if the stimulus package was not implemented, the U.S. unemployment rate would go as high as 8%. His stimulus program promised to get unemployment under 5% by May 2013 without millions dropping out of the labor force to get to that level. Well, the stimulus package was passed and the unemployment soared over 8% and stayed there for a record number of months, only recently dipping below 8% and only because so many Americans stopped looking for a job. Failed promise.
  • "Shovel-ready was not as shovel-ready as we expected," said the President in one of the bigger understatements of his administration. One of the biggest catch words of the stimulus program was that the money would be put to work immediately in so-called “shovel-ready” jobs. These jobs would be good paying, solid, long term jobs that built roads, repaired bridges, retrofitted schools, and did other good for society immediately. Several years later, even the President realized that there were no shovel ready jobs. Instead, the administration spent taxpayer wealth on replacing windows in a national park building that had been shut down and would never be reopened, a study of insects on an island half way around the world, and hundreds of other equally inane and useless programs, none of which were shovel ready jobs. Failed promise.
  • "I won't stop fighting to open up government... we have put in place the toughest ethics laws and toughest transparency rules of any administration in history." Unfortunately, the Obama administration is even more secretive and unethical than the Bush administration. Failed promise.
  • "But I want you all to know, I will not rest until anybody who's looking for a job can find one -- and I'm not talking about just any job, but good jobs that give every American decent wages and decent benefits and a fair shot at the American Dream." The Independent Journal Review claims that the President has taken at least 57 vacation days since making this statement in late 2009. But worse, he has held dozens of photo op meetings with NFL, NHL, NBA, college, and other sports teams that have been crowned champions in their respective sports. He has spent hours and hours talking about his college basketball picks during March Madness. He has probably attended hundreds of political fund raisers, including one within 24 hours after the attack and deaths at the Benghazi consulate. The overwhelming, most critical issue facing the President was the economy and jobs and he spent a lot of wasteful time on useless activities that had nothing to do with being President and reducing the unemployment rate. Failed promise.
  • “Let me be exactly clear about what health care reform means to you. First of all, if you’ve got health insurance, you like your doctors, you like your plan, you can keep your doctor, you can keep your plan. Nobody is talking about taking that away from you.” But the Congressional Budget Office estimates that at least 7 million Americans will lose their current health insurance coverage as a result of his so-called health care reform legislation. Failed promise.
  • “Now, add it all up, and the plan (Obama Care) I'm proposing will cost around $900 billion.” But the latest reputable estimates put the current cost not at $900 billion but almost double that amount, over $1.7 TRILLION. Failed promise.
  • "This Administration (Bush administration) puts forward a false choice between the liberties we cherish and the security we provide…I will provide our intelligence and law enforcement agencies with the tools they need to track and take out the terrorists without undermining our Constitution and our Freedom. That means no more illegal wiretapping of American citizens, no more National Security letters to spy on American citizens who are not suspected of a crime. No more tracking citizens who do nothing more than protest a misguided war. No more ignoring the law when it is inconvenient." These words came from Senator Obama back in 2007. Looks like he really blew this promise, given his approval of wiretapping every Verizon customer, the seizing of Americans’ electronic devices in border areas, the confiscation of internet records, etc. Failed promise.
And these examples do not even cover all of the failed promises, e.g. cutting the Federal government spending deficit in half in his first term, a number that he actually sent to record high levels. For a more detailed list of failed promises, access the following link that lists out 19 of the President’s more blatant failed promises:

http://www.ijreview.com/2013/06/58005-president-obamas-broken-campaign-promises/1/

In light of all these disgraceful invasions of privacy and the multitude of failed promises by Obama and his administration, he now has the audacity of putting forth this quote this past week: "If you can't trust us, we're going to have some problems." WE are not going to have problems, you, Mr. President, have a canyon wide trust and integrity problem. How can we believe anything you tell us, given your administration’s recent anti-liberty actions and your history of failed promises?

This is truly the face of tyranny. Government intrusion and abuse of privacy in a democracy. The silencing of whistleblowers. Using government agents and agencies to silence political opponents and religious freedom. And then accusing the governed of having a trust problem. Despicable and disgusting.

But possibly we can learn from others, from today and in the past, when it comes to tyranny and how to handle it since tyranny of this scope has never been seen to this degree in this country. This education process starts tomorrow as we continue this series of “government gone wild.”

Obama Care Will Apply To All Americans...Except for Those Covered By The 1,040 Waivers That Have Been Issued

There are many reasons to despise and doubt the many components of Obama Care. The latest set of numbers from the Department Of Health and Human Services (HHS) adds another layer of doubt that the political class really had any sense of reality when they passed the legislation. Less than a year after the legislation was passed, HHS has already granted 1,040 waivers to the law to various organizations across the country.

This raises some pretty obvious and simplistic questions:
  1. If this law is so good, why have so many waivers been granted so quickly for temporary exemptions from the law?
  2. How could the architects of this law not have even a clue that it would adversely affect so many Americans so quickly (the healthcare blog from "The Hill" estimates that these 1,040 waivers/exemptions cover about 2.6 million Americans).
  3. Since over 800 waivers have been granted just over the past three months, how many more waivers affecting how many more Americans are yet to be granted?
  4. Accusations have been made that many of these waivers have been granted to union organizations, the very types of organizations that supported Obama Care in the first place: is this granting of waivers a payment for union support for the passage of Obama Care?
Just another aspect of this very bad law. Let's review all of the negative aspects of the law that have erupted or oozed to the surface so far:
  • While the Congressional Budget Office (CBO) originally estimated that Obama Care would reduce the Federal deficit by about $135 billion over ten years, their estimate did not include all of the components of Obama Care that were finally included in the legislation. Associated Press analyses found over $100 billion of excluded costs that at the very, very best case makes Obama Care deficit neutral, not positive.
  • Even so, the ten year CBO analysis included ten years worth of revenue and taxes and only six years worth of expenses, an apples to oranges, invalid analysis.
  • Some of the starting programs of Obama Care are woefully under enrolled, missing their estimated enrollment totals by over 95% in most cases, indicating that maybe these programs are not as good as the political class would have us believe.
  • Twenty six states, more than half of the state governments in the country, are in court trying to stop various aspects, if not the whole, of Obama Care. While there are obviously some degree of partisan politics in play here, if Obama Care was that great, there would be no basis for the state court actions. Given that two judges have already found serious flaws with the legislation indicates that the 26 states may be on the right track.
  • The current legislation gives very little credence or support to medical tort reform, a strategy that has significantly reduced health care costs in states that have already implemented tort reform in this area.
  • This legislation gives very little credence or support to allowing insurance companies to easily operate across state lines, which would increase health insurance competition and reduce costs.
  • This legislation gives very little credence or support to reducing the main culprits of bad health and increased health care costs in this country: smoking, bad eating habits, and lack of exercise of most Americans. Thus, even if Obama Care works perfectly, which is highly unlikely, the root causes of our high national health care costs will still be in place: Americans smoke too much, Americans eat too much of the wrong kind of food, and Americans do not exercise enough. These life style root causes will not be solved by Obama Care which is only a doomed taxing and government bureaucracy approach, not a life style and personal responsibility approach.
  • Although Obama Care is supposed to reduce health care costs and allow more Americans to get health care insurance, the legislation is structured so poorly and so stupidly that many major U.S. corporations (AT&T, Verizon, John Deere, MacDonald's, others) have already publicly stated that they may drop health care insurance for their employees and retirees since it would be less expensive, under Obama Care, to pay the Obama Care fine than continuing to offer health care insurance for their people. Thus, a political class action to reduce the number of Americans without health care insurance is likely to attain just the opposite result: increase the number of Americans without health care insurance. Brilliant!
  • This legislation, via its mandate that orders all citizens to buy a product/service that they may or may not want, health care coverage insurance, is a basic violation of our freedom to choose and to live our lives as we see fit.
So let's review. This legislation is so bad that every month, hundreds of American companies and unions get exemptions from the law. This legislation is so bad that it will likely increase the number of Americans without health care insurance, the exact opposite of what is supposed to do. This legislation is so bad that it does not address the underlying life style root causes, meaning it will never solve the symptoms of high health care costs and high uninsured rates. This legislation is so bad that the very people it is supposed to be helping already have basically ignored the programs it introduced. This legislation is so bad that over half of the state governments in the country are in court to stop the law, an unprecedented move on any other Federal legislation in our history. This legislation is so bad that the Democrats in the political class did not even have the class and courage to pass the law in traditional ways, needing to sneak in the side door of reconciliation to get it passed. The legislation is so bad that there are serious flaws in the methodology and analysis used to prove its financial worthiness. This legislation is so bad that it undercuts our basic freedom of choice in this country with its government mandates.

What is needed is not an individual waiver from Obama Care. What is needed is a waiver of the entire program and a fresh start as outlined in Step 28 of "Love My Country, Loathe My Government." Step 28 lays out a logical, problem solving approach to health care in this country without the intrusion of the political class and the accompanying lobbyists. We see what the political class and lobbyists have gotten us, it is time to put a waiver out on them and do the job right the next time.
